mayor matt mahan undercover police guard was released from jail today. thank you for joining us here on kron for news at 5. i'm noelle bellow. i'm ken wayne. our cameras are there downtown san jose. win that fight broke out, sending the police officer to the hospital briefly. crawford check moment was a reporter who caught on camera and he was in the courtroom today and joins us live with the latest on what happened in court. jack. >> yeah, that's right. wesley pollard, that's the name of the man who was seen in that video that seemingly spread on social media now like wildfire. will be released from santa clara county jail here later this evening. but that was before earlier today with the judge originally wanted to keep him in jail. and it wasn't until he saw the kron. 4 video this afternoon that changed his opinion. now pollard is charged with battery, disturbing the peace and a felony charge of threatening an officer in court today. the judge said that since pollard has a warrant for his arrest in the state of georgia. and according to the police report, did not listen to the office's efforts to keep him

away. the judge said, quote, i am not inclined to release and quote, the attorney for polly requested that the judge look at the kron. 4 video of the full arrest before issuing his ruling. the attorney argued that pollard was actually trying to get away and not escalate the fight. the judge looked at the video and ended up changing his outlook on he granted pollard to be from several conditions, including staying 300 yards away from mayor matt mahanrand the san jose police officer that was on the cover at that time. and again, like i said earlier, pollard is expected to be released from santa clara county jail later this evening. now i did speak with some people within san jose city hall and they tell me that they do recognize wesley pollard and they say that he's actually threatened them before. so that's what's going on here. we'll send it back to you guys in the studio. so jack, did the judge seemed to get a picture that this was worse than what was in the video from prosecutors. >> and decided to i mean, what changed his mind after seeing the video? what was it that seem to making determine that he should be released. well, i

think the big thing was that the judge did tell the court room that he didn't watch the video all before coming in today and that he was just reading initial. >> police report and defense attorneys for wesley really urge them to look at to side more case. and i think something that the police really noted of was how many times the police officer tried to tell mister pollard to back away now, the defense attorneys wanted the judge to look at the video to see some of the more quote, defensive moves pollard was trying to make about was the defense's argument there looks like the judge may have listen to some of that when he watched that video. and and also on his warrant out of georgia, he. >> he's wanted in georgia for a similar type of crime, resisting arrest. i believe in georgia. what's to prevent him from taking off again. i mean, he he's already shown that he's not going respond to a warrant. right, that that's

very true. and i think something that defense wanted to point out for mister pollard was that. >> while he he is wanted in georgia, he does not have a criminally violent history. and i think they made a big note about and i think that's what really waiting to the judge's decision here. now, i think the future of this case really remains to be seen. but he is expected and he being requested to be back in court on july. 11th. >> i know that you'll continue to be following up on this story. jack, thank you. joining us live from san jose this evening. >> happening now about 1000 people have been forced to evacuate the costco in refrigerant leak. the stories on monument boulevard and detroit avenue. fire officials say employees there became aware of that around 2 o'clock this afternoon when someone spotted a white cloud moving through the store, refrigerant is a fluid used in air condition systems and heat pumps depending on exposure. injuries from a leak can be mild or severe. no injuries

have been reported so far and there's no estimated time for the store to re we have been hearing that the entrances to the parking lot is still blocked off right now. but kron four's dan thorn is headed there now working to gather more details. we'll bring you his report tonight at 10 11 o'clock. >> we're learning new details about that fiery car crash in pleasanton that killed a family of 4. police say the 2 children who died were under the age of 15. police also say speed may have been a factor in the crash. the single-vehicle crash happened wednesday night at the area where foothill road switches from 2 lanes to one. it's just south of stone. ridge drive near the mall. police say the c'r swerved off the road onto a light pole and then hit a tree. officers say they don't believe alcohol or foul play were factors in the crash. >> today the bay area honored the legacy of oakland police officer jordan wingate. his funeral was held this morning at 3 crosses church in castro

valley. his casket was met with officers from all across the bay area. officer wingate is being remembered by his family and colleagues as an excellent police officer and a good man. >> a son, a brother, a family member, a friend, a talented police officer with bright future with so much for college and so much more to humanity. new george described dedicated, hard-working, respectful and fighting practical joker. just like that. yeah. huge part in a way you feel like you are his best friend. >> officer wingate was gravely injured 6 years ago while on duty and a major car accident he pass from his injuries last weekend. when gate is the 55th oakland police officer to die in the line of duty. >> students at stanford university are now joining nationwide protest showing their support for palestine and calling for the university to stop any financial aid to

israel. kron four's rob nesbitt spoke with some students who are tempting out on campus. he joins us live now with more on what they're hearing from the university about their protests. it looks like it's very active out there, rob. >> no, well, and can it very much is active. i'm in white memorial plaza here, stanford university and behind me is where they have about 25 to 30 tents set up. there are tense signs. they have food. they look like they're here for the long haul calling for cease-fire in gaza. >> the mood was relaxed with music friday afternoon inside what's being called the people's university for gaza around. 25 tents set up by students at stanford university to protest the war in gaza. they don't have >> you could make that happen. they have left. >> the tense formed after hundreds gathered for a rally at the university thursday afternoon. one of the organizers, young soo kim says

her speech. more fallout from college campus protests. there were some heated interactions at ucla today. >> there was created yesterday by pro-palestinian. protesters want the university to end all funding connected to israel. that's while heightened security measures remain in place all around the usc campus entry. there's limited to just staff and students and for students in the graduating class of 2024, heartbreak is still sinking in about commencement cancellations. columbia university facing similar challenges in encampment at that new york campus remains despite a deadline from the school to clear out the jewish community federation is calling on the u.s. government to take action. the organization says the pro-palestine protest that led to threats and harassment of jewish students and faculty. in a statement the organization says, quote, we urge united states congress to quickly consider and adopt the anti-semitism awareness act as the school year draws to a close and commencement activities begin are campuses must be safe and welcoming for

all students. those who seek to disrupt and intimidate must be dealt with swiftly and decisively, end quote. >> some oakland residents gathering outside the county administration building this morning for a rally against a special election recall for district attorney pamela price. the group, asian americans for progressive, alameda showing support for the da calling the election a waste of hard earned tax money. a recall election could cost the county around 20 million dollars. that's according to the alameda county registrar of voters. meantime, the group asking for a recall is hoping county supervisors will set an election date during next tuesday's meeting now than enough signatures have been verified. all right. step outside. give you a live look at a wide view of the city where it's cleared out a lot since yesterday. yeah, definitely a little windy as

well. i guess the wind helped clear everything out, yeah, that wind blown around. we've had some gusts over 40 miles an hour. >> around the bay area's. that's a big weather story. now, of course, last night we have the showers drop through the bay area. those winds kicking up outside, though, right now, skies trying to clear out in parts of the bay area at this time. but we're going to see a few more clouds on the way overnight tonight and early tomorrow morning as some of that patchy fog likely to form as well. but check out all the winds around the bay area right now. even inside the bexar little wind sheltered there. you're still seeing 30 mile an hour gusts at sfo. 27 right now in san francisco. 24, that's into beach. even 25 mile an hour winds and napa. so it's kind of a blustery afternoon around the bay area. maybe a little blowing sand along the coastline and ocean beach right there. they've seen some gusts as high has 44 miles per hour. all part of that system rolled through yesterday that brought us some scattered light showers up, pushing the east now moving out of town. but behind you have those gusty winds kind of settling in as high pressure tries to build on the backside of that low and some thunderstorms

popping up over the sierra nevada as well. and some snow over the high country as well. what about the weekend ahead? we'll talk more about that coming up in a few minutes. thank you, lawrence. highway closures are continuing across the bay area tonight. this is the bound lanes of 6.80. it will be close to around the 5.86. a t intersection in pleasanton and koopman road. >> caltrans says it's closing tonight at 9 o'clock and reopening monday morning at 4. so all weekend it's going to be shut down. caltrans says to expect delays and detours this weekend. the second big closures, parts of the westbound lanes on highway. 37 in vallejo heading towards sears points. they're also closing tonight at 9 o'clock. and again, reopening monday morning at 4. and then next weekend, the eastbound lanes eastbound lanes of highway 37 will be closed for repairs. >> coming up, rising from the ashes horn barbecue officially back open following a series of unfortunate events. thousands of dollars in stolen merchandise recovered in the east bay. how a resting one

latest victim of a car break-in. thieves stealing his luggage. >> as his car was parked in a downtown san francisco parking garage, though some consider smashed in windows to be synonymous with the city. officials say they're in the process of improving its reputation even after this latest high-profile incident kron four's lezla gooden. joining us live from the newsroom with the latest. that's right. while he was viiiting san francisco, the southern called for a congressman. >> had his car broken into just before attending that fundraising dinner for his senate campaign. now, although he's not the first person have this happen to auto thefts, appear to be decreasing in the city, according to police. adam ship is currently running to fill the late senator dianne feinstein, senate seat. >> and was in san francisco making several appearances. he was dining at the thing restaurant when his luggage was stolen while his car was parked and a downtown parking garage, his luggage allegedly in view on facebook. the democratic congressman posted this picture at the restaurant

to murder his ex over a child custody dispute. officials say 49 year-old alan gessen was in a years long legal battle over custody of his 2 children with his ex-wife, they say his original plan was to bribe immigration agents to deport her to her home country. but then he decided to cheaper and more permanent option. was the killer gessen gave an fbi agent details about his ex, including her home address social media accounts, boyfriend and lifestyle. he was indicted by a grand jury in 2022. on one count of murder for hire. >> multiple bay area. law enforcement agencies have recovered more than $300,000 worth of stolen goods in oakland, the california highway patrol says they found products from stores like walmart, tj maxx and sunglass hut in this suspected fencing operation. the investigation began last september in san mateo county when sheriff's deputies arrested several people linked to retail theft in the area. just 2 months later, san ramon police link 2

mile an hour gusts in the san francisco. i overnight tonight those winds going to start to back off just a little bit. but overall, yeah, it looks like we're going to see this pattern begin to dry out. still on the breezy side, though, as we get toward tomorrow afternoon. so we're bringing acts more sunshine and warm those temperatures up. i think we sneak back up in the 70's parts of the bay area tomorrow still breezy along the coastline, especially if you're headed up there. watch out. those winds will blow in lots of white caps out all right. thanks aren't welcome. loved east bay restaurant horn barbecue is officially back open today after that devastating fire people lined up outside of maddie's old-fashioned on 8th street to get a taste. >> there he is. chef matt horn preparing a menu of brisket wings and beef sandwich is with all the trimmings barbecue fans coming from all over the bay area to celebrate for most. it was their first chance to chow down on the james beard. recognize grub since last fall. that's one of the fire at the old location force horns to shut that location down. >> the fire took a lot out of us. you know, i mean, those

>> welcome back. the family of a man tased by east bay regional park. police is demanding answers. dante, a phase on has been in a coma since april 5th. that's when he and a friend were eating food in his car at martin luther king junior regional shoreline park park. police approached them because jan taste tags were expired. police say he attempted to run away and ended up going into the water and that's when they tased him down to what i'm conscious while in the water. the lawyers for his family say cpr was not administered until 30 minutes after he was unconscious. the family of dante has now filed a lawsuit with the park district and the county. san mateo county

sheriff's department is getting a training on autism later this month. deputies will work with an expert on how to help individuals on the spectrum in both crisis and everyday situations. this is because autism can be more difficult to recognize about training and experience. the sheriff's office says this will help staff to better serve the community with better outcomes. >> san francisco mayor london breed wants to get rid of financial barriers for food vendors who are participating in markets and block parties. currently businesses that participate at community events are required to buy a temporary permit. each time that permit can cost up to $300 depending on the food. now the mayor is proposing to waive those fees. so the special permit the vendors will only have to buy once she says food vendor streamlining will benefit small businesses and keep fun in the city. event that could be coming to san francisco. the sundance film festival, the san francisco film commission says it has submitted a bid to become the new host city for the prestigious film festival.
